18 U.S.C. §2257 statement

ponstars is a platform. It does not produce, direct, film, edit, or script any of the material broadcast through it, and it does not select or pay the people who appear in it. Every broadcast originates from a performer's own camera and is transmitted live.
Our position under §2257
With respect to live streams transmitted by third parties, ponstars is not a "producer" as that term is defined in 18 U.S.C. §2257 and 28 C.F.R. §75.1(c)(4). Our role is limited to transmission — the exemption for those whose activities are limited to transmission, storage, retrieval, hosting, formatting, or translation applies.
What we require instead
Every performer must, before a channel is opened, affirmatively attest under the terms of service that:
- they are at least 18 years of age;
- every person appearing in their broadcast is at least 18 years of age and has consented to being recorded and transmitted;
- they hold, and will retain, government-issued age identification and written consent for every such person, and will produce those records to ponstars or to law enforcement on request.
That attestation, the name signed, the wallet address that signed it, the timestamp and the originating network address are retained for the life of the channel and afterwards.
Custodian of records
Records maintained by individual performers are held by those performers, who are identified to us by the on-chain wallet that deployed their coin. Records maintained by ponstars — attestations, broadcast logs and report history — are available to law enforcement on lawful request via the contact below.
Zero tolerance
ponstars has a zero-tolerance policy toward child sexual abuse material, any depiction of a minor, and any non-consensual recording. Reports in either category suspend a channel automatically and are referred to the National Center for Missing & Exploited Children and to the appropriate authorities. Suspension in these categories is permanent and is not appealable.
